What is the Housing Element?

The Housing Element of the General Plan assesses Milpitas’s housing needs for the next eight years, identifies opportunities, and establishes clear goals and policies to inform future housing decisions. Housing Element lays the groundwork for citywide housing policies and implementation programs and should in alignment with the city-wide General Plan and Specific Plans.
The purpose of the Housing Element is to facilitate the production of a variety of housing types, at different income levels, for different household and family types. The Housing Element seeks to remove constraints to housing production, improve and preserve existing housing in the community, and promote fair housing.

The Housing Element is mandated by State law to be updated every eight years and certified by California’s Department of Housing and Community Development (HCD). The 6th Housing Element will shape and guide housing development from 2023 through 2031.

What is included in
a Housing Element?

A typical Housing Element includes the following:

  • Housing Needs Assessment reflective of the City’s demographic, economic, and housing characteristics.
  • Constraints Analysis to remove barriers to the production and preservation of housing.
  • Sites Inventory with a list of potential sites that could accommodate future housing to meet the City’s Regional Housing Needs Allocation (RHNA).
  • Goals and Policies to promote housing production and define its characteristics.
  • Review of existing housing programs and their progress.
    Community Outreach and Engagement with a particular focus on key stakeholders and traditionally underrepresented groups.
  • Fair Housing Assessment to ensure fair housing and opportunity for residents.

Fair Housing

The Fair Housing Act of 1968 prohibits discrimination in the sale, rental, and financing
of housing based on race, religion, and national origin.

Project Timeline

Milpitas Housing Element will unfold over the next 14 months in different phases. Public engagement is a core component of the Housing Element Update and will inform the planning process throughout the different stages.

The Housing Element Update will carry forward the community engagement and discussions from the General Plan update process. There will be multiple opportunities for the community to participate and provide feedback on the Housing Element through public workshops, online surveys and City Council and Planning Commission meeting sessions.

COVID-19 Acknowledgement

The COVID-19 pandemic has exacerbated housing inequalities in cities and requires a longer-term approach to support vulnerable populations and essential workers. The Housing Element update process is an opportunity to address vulnerable populations, racial and spatial equity, reduce displacement, increase affordability, and build healthy communities for all.
The city will adhere to COVID-19 protocols through its public engagement process and avoid in-person or large group gatherings to protect the health and safety of residents, staff, and visitors.
